COLUMBIA, SC (WIS) – The death of a 17-year-old Florida teen gunned down by a neighborhood watchman is not only taking over the Internet and airways, it's also bringing gun laws to light.

Trayvon Martin's death has even sparked an event called the “Million Hoodie March”. Martin was unarmed and wearing a hoodie when he was shot last month.

Back in South Carolina, the case is drawing comparisons to the Palmetto State's gun laws and other cases.

Back in February of 2011, homeowner Richard Williams confronted a man breaking into his truck. The intruder shined a flashlight into Williams' face and Williams responded with two gunshots. Forty-four-year-old mark Edward Howard collapsed in the street and died.

The solicitor's office decided not to prosecute the case.

“The question was asked is do you have any evidence that this is anything other than self-defense. and the answer I got was, we have zero evidence that it was anything but self-defense,” deputy solicitor Dayton Riddle in a previous interview.

The West Columbia incident illustrates the long-standing rights of South Carolinians to use deadly force in defending themselves in their own homes.

But in 2006, lawmakers expanded those rights. Allowing anyone who feels “reasonable fear of imminent peril” to defend themselves or someone else in a business or vehicle or other place outside the home.

Veteran defense attorney Jack Swerling explains.

“If you're in a store, you're in a park, you're in an office, if you have a right to be there and you're not acting unlawfully, and someone attacks you in that area, then you have a right to stand your ground and not retreat,” Swerling said. “Which was the old principle was that you had to retreat and avoid the confrontation.”

Swerling dealt with related issues in handling the case of Jason Dickey.

In 2004, Dickey was working security at the Cornell Arms apartments in Columbia when he encountered two young men. Near the front entrance, one of them moved toward Dickey. Dickey fired at least two gunshots, killing 24-year-old Josh Boot. Dickey was eventually convicted of voluntary manslaughter. but last September, the state Supreme Court overturned the conviction and freed Dickey from a 16-year prison sentence.

Swerling says even with broader abilities to act in self-defense, South Carolina law sets limits. People cannot, for instance, pursue someone they feel has threatened them.

“You can't go beyond that. I mean, it is a protection doctrine for yourself. you can't go outside that and expect to invoke that statute that you had this immunity from prosecution,” Swerling said.

These broader self-defense powers have at times become problematic for law enforcement. They make it easier for someone to plead self-defense and it has become harder for police and prosecutors to charge someone with a crime or to convince a jury that deadly force was unwarranted.

In Florida, a Tampa newspaper found the number of “justifiable” homicides had tripled since the “Stand Your Ground” law went into effect.
